NL - Rent control
This section describes the rent control settings for the Netherlands.
Each dwelling in the Netherlands falls into a segment. As of 1 July 2024, there are three segments: lower segment, middle segment, and higher segment. The relet rent for the lower and middle segments is regulated.
To estimate which segment a dwelling falls into depends on the WWS points of the dwelling and the corresponding WWS table. The law distinguishes four different WWS tables: independent dwellings, non-self-contained dwellings, mobile homes, and mobile home stands. Each WWS table specifies the maximum statutory rent per month based on the number of points. For each dwelling that has WWS points and a WWS table, a lookup can be performed in the corresponding WWS table.
The relet rent is regulated when it concerns a dwelling located in the Netherlands and the relet rent is below the maximum middle rent ceiling. The maximum middle rent ceiling is determined by the government based on the WWS points of an independent dwelling. If the relet rent is above the maximum middle rent ceiling, rent control does not apply.
Through the source data, a manual rent cap can be provided. The rent cap includes an end date. When a relet moment occurs during the forecast period, the system will determine the minimum of the maximum statutory rent per month, the rent cap from the source data (taking the end date into account), and the estimated rental value per month.
Rent ceiling
There are two rent ceilings: the maximum lower rent ceiling and the maximum middle rent ceiling. The ceiling is provided as WWS points, which are looked up in the WWS table for independent dwellings.
Index methods after relet
The indexation of a residential rental contract in the Netherlands is based on the rent law type. A dwelling can fall into the lower segment, middle segment, or higher segment. For existing contracts, the user can provide an index method per contract line. In the case of the Netherlands, best practice is to define at least one index method for each of the three segments.
However, after relet, the segment may change. This is based on the number of WWS points assigned to the rentable unit. Since the index method is linked to the rent law type, REM needs to know which index method applies to which rent law type after relet.
Therefore, the system administrator must select the index methodology per segment.
WWS tables
The WWS tables consist of WWS points and the corresponding statutory maximum rent for specific dwelling types, and are used as an initial rent cap for Dutch residential dwellings. The WWS tables are updated annually by the Dutch government on 1 July. The reference date of the statutory maximum rent corresponds to the date stamp of the WWS table.
The system administrator can add a new WWS table or duplicate an existing one. The reference date of each WWS table must be unique. WWS points must be entered in sequential order without any missing numbers. The statutory maximum rent must increase with each additional WWS point.
New construction surcharge
For dwellings that fall within the middle segment, surcharges can be added on top of the calculated maximum statutory rent. These surcharges are not taken into account when determining the segment in which the dwelling is rented. This means that an independent dwelling with 186 points is still considered part of the middle segment.
The surcharge and its applicable period are taken into account. The surcharge is only applied if the key handover date is on or after 01/07/2024. It starts from the key handover date and ends after the surcharge period.
Monument surcharge
For dwellings that fall within the middle segment, surcharges for different monument types can be added on top of the calculated maximum statutory rent. These surcharges are not taken into account when determining the segment in which the dwelling is rented. This means that an independent dwelling with 186 points is still considered part of the middle segment. The list of monument types is based on the client pick list monument type and displays all available items.
